For X1X PAYGO Devices Only
HOW CONSUMER LAW RELATES TO THIS WARRANTY
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS UNDER THE LAWS OF KENYA, AND YOU MAY HAVE OTHER RIGHTS WHICH CANNOT BE EXCLUDED OR LIMITED BY LAW. NOTHING IN THIS WARRANTY LIMITS OR EXCLUDES ANY RIGHTS YOU MAY HAVE UNDER APPLICABLE KENYAN CONSUMER PROTECTION LEGISLATION.
TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED.
WARRANTY LIMITATIONS SUBJECT TO CONSUMER LAW
TO THE EXTENT PERMITTED BY LAW, BASELAYER X1X LTD DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS.
WHERE SUCH WARRANTIES CANNOT BE DISCLAIMED UNDER LAW, BASELAYER X1X LTD LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS WARRANTY AND THE REPLACEMENT REMEDY DESCRIBED BELOW.
WHAT IS COVERED BY THIS WARRANTY?
BaseLayer X1X Ltd warrants the X1X PAYGO laptop device (“Device”) against defects in materials and workmanship when used under normal operating conditions in accordance with published guidelines, for a period of ONE (1) YEAR from the date of device activation and delivery to the end-user purchaser (“Warranty Period”).
This Warranty applies to:

Motherboard and internal circuitry defects
-
CPU, RAM, SSD hardware failure
-
Internal display failure due to manufacturing defect
-
Battery failure due to manufacturing defect
-
Other internal component defects not caused by misuse
All claims are governed exclusively by the terms set out in this Warranty document.
BATTERY HEALTH POLICY
All X1X devices are professionally tested prior to delivery.
At the time of delivery, batteries are guaranteed to retain a minimum of 85% of original design capacity.
Battery degradation after delivery is considered normal wear and is not covered unless caused by a verified manufacturing defect.
Battery lifespan reduction due to usage patterns does not constitute a warranty breach.
DISPLAY / DEAD PIXEL POLICY
Minor pixel irregularities may occur within industry tolerance.
A display qualifies for replacement under this Warranty only if:

Three (3) or more defective bright or dark pixels are present within the central viewing area.
Single dead pixels or edge pixel anomalies do not qualify for warranty replacement.
WHAT IS NOT COVERED BY THIS WARRANTY?
This Warranty does not apply to:
(a) Cosmetic damage including scratches, dents, worn surfaces or paint wear
(b) Damage caused by accident, impact, abuse or misuse
(c) Liquid damage, moisture exposure or internal corrosion
(d) Electrical surge damage or unstable voltage unless certified surge protection was used
(e) Theft, loss or accidental breakage (including screen cracks)
(f) Damage caused by unauthorized opening, tampering or hardware modification
(g) Damage caused by bypassing or attempting to bypass K-Lock™
(h) Installation of unauthorized or pirated software
(i) Normal wear and tear including battery degradation within expected range
(j) Devices with removed or altered serial identifiers
SOFTWARE & SYSTEM CONTROL
This Warranty covers hardware only.
All X1X PAYGO devices operate with:
-
K-Lock™ system security
-
Controlled Microsoft Store installation environment
-
X1 Intelligence system layer
Microsoft software installed under system guidelines is permitted.
Unauthorized system modifications, bypass attempts, or security circumvention void this Warranty immediately.
BaseLayer X1X Ltd does not guarantee uninterrupted or error-free operation.
YOUR RESPONSIBILITIES
If your Device stores software programs or data, you are responsible for maintaining backup copies.
Before submitting a Device for Warranty service, you must:

Provide proof of purchase and activation
-
Back up all data
-
Remove personal information
-
Disable security credentials where required
BaseLayer X1X Ltd is not responsible for loss of data during service or replacement.
WHAT WILL BASELAYER X1X LTD DO IN THE EVENT THE WARRANTY IS BREACHED?
If during the Warranty Period a covered defect arises, BaseLayer X1X Ltd will, at its sole discretion:
(i) Replace the Device with an equivalent X1X device of similar model and specification.
BaseLayer X1X Ltd does not provide component-level repair during the Warranty Period.
Replacement devices may contain new and/or professionally refurbished components that meet functional standards.
Replacement devices assume the remaining term of the original Warranty Period.
Replacement is permanent.
HOW TO OBTAIN WARRANTY SERVICE
If your Device experiences a suspected hardware defect:

Contact BaseLayer X1X Ltd support.

Provide proof of purchase and activation.
-
Follow diagnostic instructions provided by support.
-
Deliver the Device to the designated inspection location if requested.
After verification of a covered defect, replacement will be provided within a reasonable time, subject to stock availability and logistical factors.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BASELAYER X1X LTD SHALL NOT BE LIABLE FOR:

LOSS OF USE

LOSS OF INCOME
-
LOSS OF PROFITS
-
LOSS OF BUSINESS OPPORTUNITY
-
LOSS OF DATA
-
INDIRECT OR CONSEQUENTIAL DAMAGES
Nothing in this section excludes liability for death, personal injury, or statutory obligations under Kenyan law.
TERRITORIAL LIMITATION
Warranty service is limited to Kenya unless otherwise agreed in writing.
GOVERNING LAW
This Warranty shall be governed by the laws of Kenya.
Disputes shall be resolved by the Kenya Small Claims Court or other competent courts within Kenya.
SECTION 11 – FINANCIAL HARDSHIP POLICY
BaseLayer X1X Ltd recognizes that customers may encounter unexpected financial challenges.
Under the X1X PAYGO model:
(a) Early Notification
Customers experiencing verified financial hardship (e.g., medical emergency, loss of income) are encouraged to contact BaseLayer X1X Ltd before payment default occurs.
(b) Voluntary Return
In cases of extreme hardship, the Customer may request a voluntary return of the Device to a designated service location.
Upon inspection and evaluation, BaseLayer X1X Ltd may, at its sole discretion, offer a settlement based on the Fair Market Value of the Device at the time of return.
(c) Fair Market Value Assessment
Any Fair Market Value payment:

is determined solely by BaseLayer X1X Ltd
-
depends on the Device’s physical and functional condition
-
may be applied toward outstanding balance
-
does not automatically extinguish debt unless confirmed in writing
(d) Liability Limitation
A voluntary return under the Hardship Policy does not automatically cancel the remaining financial obligation. Any adjustment or settlement remains at the sole discretion of BaseLayer X1X Ltd.
(e) Safe-Lock Mode
During hardship review, the Device may be placed in temporary “Safe-Lock” mode via K-Lock™, preserving payment history while evaluation is conducted.
Hardship approval and any associated settlement are not automatic and remain at the sole discretion of BaseLayer X1X Ltd.
